​Subpoena Instructions

Civil and Criminal Subpoenas may be served as follows:

1. Civil - Subpoena Duces Tecum (SDT) to Produce Records
Pursuant to CPRC §22.004, the SDT must include the proper fee of $1 for production or certification of documents in order for METRO to process the subpoena. Please make your check payable to: Metropolitan Transit Authority. Cash payments are accepted. A blank Business Records Affidavit or Deposition on Written Questions should be included, as well as any accompanying releases (i.e. HIPAA release). Note that METRO will not release HIPAA related information without a properly executed HIPAA release.

A separate SDT should be issued for each of the following types of records: 1) Personnel Records; 2) Benefits/Pension/Retirement Records; 3) Payroll Records; 4) Workers Compensation/Claim Information Records; and 5) Accident/Incident Reports; 6) Labor Relations/Disciplinary Records.

Each SDT should summon the “Custodian of Records” of the particular type of record you are requesting, i.e. if you seek Personnel Records, the subpoena should summon the “Custodian of Personnel Records.”

2. Civil – Witness Subpoena to Appear in Person
Pursuant to CPRC §22.001, the Witness Subpoena must include the proper fee of $10 in order for METRO to process the subpoena. Please make your check payable to: Metropolitan Transit Authority. Cash payments are accepted. The Witness Subpoena to Appear needs to summon and identify by name, the witness that is being subpoenaed to appear.

3. Criminal - Subpoena Duces Tecum (SDT) to Produce Records
Production and certification fees are waived on Criminal matters. The Criminal SDT to Produce Records should summon the “Custodian of Records” of the particular type of record you are requesting, i.e. if you seek Accident Reports, the subpoena should summon the “Custodian of Accident Reports.”

4. Criminal - Witness Subpoena to Appear in Person
Witness fees are waived on Criminal matters. The Witness Subpoena to Appear needs to summon and identify by name, the witness that is being subpoenaed to appear.

NOTE: The Legal Department is in charge of processing subpoena requests. The Legal Department is NOT the custodian of records and, as such, Subpoenas should NOT be issued to summons the “Legal Department."
